Policies

Agreement
This is an agreement between DracoMagi Design's customers, agents, officers, partners, owners, affiliates and/or employees, hereinafter referred to as DMD and any person(s) or company it provides with products and services, hereinafter referred to as customer.

Usage
DMD reserves the right to suspend or stop service for any reason at any time.
Copyrighted Material
DMD prohibits the distribution of unauthorized copyrighted materials this includes but not limited to trademarks, logo's etc. If a site is found to distribute or archive unauthorized copyrighted material, DMD reserves the right to terminate service for that domain. DMD also prohibits any sites with direct links to other sites containing such material.
Adult Material
Adult material is defined by DMD as any photos or videos showing frontal nudity of either men or women. Any photos or videos showing women's bare chests, or any audio clips or text containing sexually explicit material. Adult material also consists of the sale of sexually explicit materials. DMD also reserves the right to determine what might be considered "sexually explicit" or "sexually related". DMD also prohibits any sites with direct links to other sites containing such material.
Backup
Although the reselling company runs daily back-ups of your website, you are ultimately responsible to maintain a current copy of your site other than the one on our server hard drives.
Payment
Pre-payment is required on all accounts a minimum of 25% preceding any design. All accounts are paid in U.S. dollars. DMD must be notified in writing to request termination of services. No refunds. All sales are final.
Privacy
Personal/confidential information (e-mail addresses, contact information, etc.) will be used exclusively for the expressed reasons we specify when gathering it. It is our policy not to share, sell, or otherwise distribute this information to any third party.
Legalese
DMD requires all use by customers or resellers be for lawful purpose only. We reserve the right to refuse service at any time to anyone for any reason. Use of the resellers servers or bandwidth through DMD in violation of any Federal, State, or Local statute, law or regulation is prohibited and constitutes grounds for cancellation. DMD does not allow sub-hosting of any kind. Customers cannot sublease, sub-host, or give away control of any portion of DMD resources unless otherwise contracted.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold DMD harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney fees asserted against DMD, its customers, agents, officers, and employees, that may arise or result from any service provided or performed, or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless DMD against liabilities arising out of: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with the reseller's server(s); (2) any material supplied by customer infringing or allegedly infringing on proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from the reseller's server(s).
Disclaimer
DMD is not responsible for any damages to said customer. This includes but not limited to down time, loss of data, improper presentation, Also DMD makes no warranties of any type or form unless expressed in a written contract between customer and DMD. DMD reserves the right to change it's policies at any time and for any reason.
